Terms of service
These terms are an agreement between you and Tonavira LLC, a limited liability company registered in the State of Wyoming, United States, of 30 N Gould St, Ste N, Sheridan, WY 82801, US (“we”, “us”), who operate Tonavira. They apply when you buy a plan or create an account. Please read section 3, which explains what this service deliberately does not do.
1. What we sell
We sell prepaid, data-only eSIM plans for use while travelling. An eSIM is delivered electronically, as a QR code or an installation link. Nothing physical is shipped.
We are a reseller. The mobile service itself is carried by partner networks in each country, so coverage, speed and availability depend on those networks and on local conditions. Mobile coverage is never uniform inside a country, and we cannot promise a signal at a particular address.
2. Who can buy
You must be at least 18, or old enough to enter a contract where you live, and you must be able to pay with a card in your own name or with the cardholder's permission. If you create an account, keep your password to yourself; you are responsible for what happens under it until you tell us it has been compromised.
3. What this service does not do
Please read this section before you rely on one of our plans as your only connection.
- No emergency calls. These are data-only plans. You cannot dial 112, 911, 999 or any other emergency number over them. Keep a phone with a normal SIM, or know that most phones can reach emergency services without a working SIM at all. Never travel relying on a data-only eSIM to call for help.
- No phone number, no calls, no SMS. You keep your own number on your normal SIM. Calls and messages over the internet (WhatsApp, FaceTime, Telegram and similar) work normally, subject to local law.
- No guarantee your device will work. Your phone must support eSIM and must not be carrier-locked. Check before you buy; we publish a compatibility list, and your network operator can confirm whether your device is locked.
4. Installing and using your eSIM
- Install before you travel, while you still have internet. Installation needs a connection, which is exactly what you will not have on arrival.
- An installation code can normally be used once. Treat the QR code like a ticket: anyone who has it may be able to install your plan, and once installed it cannot usually be moved to another device.
- Deleting an eSIM is usually permanent. Most networks cannot reissue it, and the remaining data is lost. Do not delete it until your trip is over.
5. Validity, data and fair use
Every plan shows its data allowance, how many days it lasts and which countries it covers. Each plan page states when its validity starts: on some plans when the eSIM first connects to a supported network in a covered country, on others when it is installed. Either way, the plan then runs continuously, including days you do not use it.
Unused data expires when the plan does and is not refundable and not transferable. Some plans describe a daily allowance and a reduced speed after it is used; where that applies, the plan page says so, and that is a limit set by the carrying network rather than a penalty from us. Whether tethering or a personal hotspot is permitted depends on the plan and the network, and is stated on the plan page.
6. Prices, tax and payment
Prices are shown before you pay and include any tax we are required to charge. You can pay in US dollars, euros, British pounds or one of the other currencies offered at checkout; the amount shown at checkout, in the currency you chose, is the amount we charge. If your card is in another currency, your bank sets the exchange rate and may add its own fee; we do not receive that.
Payments are processed by Stripe. We never see or store your full card number. If a payment is taken but we cannot deliver the eSIM, we refund it in full (see the Refund policy).
7. Your right to change your mind
If you are a consumer in the EU or the UK you normally have 14 days to withdraw from a distance contract. An eSIM is digital content supplied immediately, and by accepting these terms and the Refund policy at checkout you ask us to supply it straight away and acknowledge that once the eSIM has been issued to you the 14-day right no longer applies. That is what the law requires us to tell you, and it is why the QR code can reach you in seconds.
This does not take away your rights if something is faulty, and it is not the whole story: we go further than the law requires and refund an eSIM you never installed, within 30 days. The Refund policy explains when.
8. Using the service properly
You agree not to:
- use a plan for anything unlawful where you are, or in a way that breaches the carrying network's terms;
- resell our plans, or run them as a permanent connection for a business or a device farm, unless we have agreed that in writing;
- use another person's payment method without permission, or attempt to obtain plans without paying;
- interfere with the site, the app or our systems, or attempt to reach data that is not yours.
If a plan is used this way we may suspend or end it, and where the abuse is clear we may decline to refund it. If we suspend something in error we will put it right, including refunding the plan.
9. Changes to plans and to these terms
Our catalogue follows what our supply partners offer, so plans, prices and coverage can change or be withdrawn. A change never affects a plan you have already bought: what you bought is what you keep.
We may update these terms. The version in force when you bought a plan governs that purchase, and the date at the top of this page shows when it last changed.
10. If something goes wrong
Write to us first at support@tonavira.com. Most problems are an installation setting and are usually quick to fix. We usually reply within a day.
To the extent the law allows, our total liability for any claim about a plan is limited to what you paid for that plan. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law. Nothing here reduces the rights you have as a consumer under the mandatory law of the country you live in.
We are not responsible for failures outside our reasonable control (a network outage, a government restriction on mobile data, a natural event), though we will still refund a plan you could not use because of one.
11. Governing law
These terms are governed by the laws of the State of Wyoming, United States. If you are a consumer, you keep the protection of the mandatory law of the country where you live, and you may bring proceedings there.
